Customer Project Agreement

This Customer Project Agreement (“Agreement”) applies to installation and service projects performed by NJF Home Solutions (“NJF”) for the customer identified in the accompanying estimate or quote (“Customer”).

The accepted NJF estimate or quote (“Quote”) identifies the project address, scope of work, products, quantities, price, and any project-specific terms. The Quote and this Agreement together form the parties’ project contract.

Which terms apply: Sections 1–13 apply to every project. Section 14 applies only to garage organization, cabinets, storage, and custom closet work included in the Quote. Section 15 applies only to garage floor coating work included in the Quote. Section 16 applies only to screen installation, rescreening, and screen repair work included in the Quote. If a Quote includes more than one service, the corresponding service-specific sections apply to those services.

1. Scope of work

NJF will provide the labor, materials, and services expressly described in the accepted Quote. Work not listed in the Quote is excluded unless NJF and the Customer approve a written change order.

Drawings, measurements, colors, finishes, and product descriptions in the Quote identify the agreed work. Any material change to the agreed scope or product selection requires Customer approval.

2. Quote validity

Unless the Quote states otherwise, it is valid for 30 days from its issue date. Pricing and product availability may change after the Quote expires.

3. Deposit and payment

A deposit equal to 50% of the total contract price is due when the Customer accepts the Quote. The remaining 50% is due upon substantial completion, regardless of the payment method used.

“Substantial completion” means the contracted work is sufficiently complete for its intended use, even if minor touch-ups or corrective items remain. NJF will address documented, agreed punch-list items within a reasonable time. A minor punch-list item does not, by itself, postpone the final payment due date.

Additional work approved through a change order may change the total price and payment amounts. Any different payment arrangement must be stated in the accepted Quote or an approved written change order.

4. Three-business-day cancellation right

NJF voluntarily gives every Customer the right to cancel this Agreement through the end of the third business day after the date the Customer signs the Quote.

To cancel, the Customer must send a clear written cancellation notice to admin@njfhomesolutions.com identifying the Customer and project. NJF will refund all payments received if the cancellation notice is timely. NJF will not deduct material, processing, or other project costs from a timely cancellation refund.

After that cancellation period expires, the 50% deposit becomes nonrefundable, except where applicable law requires otherwise or NJF agrees in writing to a refund.

NJF will not order nonreturnable or custom materials or begin project work during the voluntary cancellation period. Any cancellation rights or notice requirements provided by applicable law remain in effect and take precedence where they provide the Customer greater protection.

5. Scheduling and delays

NJF will coordinate an anticipated installation or service date with the Customer. Dates are estimates, not guaranteed completion deadlines, unless a specific deadline is expressly agreed in writing.

Scheduling may be affected by product availability, weather, site conditions, access, approved changes, or other circumstances outside NJF’s reasonable control. NJF will communicate material scheduling changes and arrange a revised date with the Customer.

Nothing in this section limits a deadline or remedy required by applicable law.

6. Customer responsibilities and site access

The Customer will provide safe and reasonable access to the work area, working electricity and water when reasonably needed, and any agreed access instructions.

Before NJF arrives, the Customer will remove vehicles, personal property, stored items, and other obstructions from the designated work area unless the Quote expressly includes moving them. The Customer is responsible for securing pets and identifying known hazards, concealed utilities, leaks, moisture problems, or other conditions that could affect the work.

NJF may pause work if the site presents an unsafe condition or is not ready for the agreed services. Any resulting change in scope, price, or schedule will be discussed with the Customer.

7. Changes and additional work

Changes to products, materials, layout, quantities, or services must be approved by the Customer before NJF performs the additional or revised work. An approved change order will describe any adjustment to price and scheduling.

NJF is not required to perform work outside the accepted Quote without an approved change order.

8. Concealed or preexisting conditions

The Quote is based on conditions reasonably observable before work begins. Concealed damage, unsuitable substrates, moisture intrusion, structural defects, hidden utilities, deteriorated framing, or other conditions discovered during the project may require additional work or a change in method.

NJF will notify the Customer if such a condition materially affects the agreed work. NJF will not proceed with additional chargeable work without Customer approval. NJF does not warrant or assume responsibility for correcting preexisting conditions unless their correction is expressly included in the Quote.

9. Products, materials, and appearance

NJF will use the products and materials identified in the Quote, subject to availability. NJF will obtain Customer approval before making a material substitution that changes the agreed product, quality, color, finish, or price.

Samples, photographs, digital renderings, and showroom displays may differ slightly from installed products because of lighting, material variation, surface conditions, and manufacturing tolerances. NJF will discuss any material appearance concern identified before installation when reasonably possible.

10. Workmanship warranty

NJF provides a one-year workmanship warranty beginning on the date of substantial completion. During that period, NJF will inspect a reported concern and, if it results from defective workmanship by NJF, repair or correct the affected work at no charge to the Customer.

The workmanship warranty does not cover manufacturer defects governed by a separate manufacturer warranty; normal wear; misuse, abuse, impact, or accidental damage; unauthorized alterations or repairs; failure to follow provided care or curing instructions; or damage caused by preexisting conditions outside NJF’s contracted scope.

Service-specific warranty limitations appear in Sections 14–16. Manufacturer warranties, if any, are separate and subject to their respective written terms.

To request warranty service, the Customer should contact admin@njfhomesolutions.com and provide the project address, a description of the concern, and photographs when available.

Nothing in this Agreement excludes rights or remedies that cannot lawfully be waived.

11. Permits and regulated work

Responsibility for any permit, inspection, or other approval required for the quoted work must be identified and resolved before that work begins. NJF will not treat a project as permit-exempt solely because it is described as a repair or installation.

Work requiring a particular license, permit, or qualified trade will be performed only when the applicable requirements are satisfied.

12. Project records and photographs

NJF may photograph the work area and completed work for estimating, installation documentation, quality control, and warranty records. NJF will seek separate Customer permission before using identifiable photographs of the Customer’s home or property for advertising or marketing.

13. Agreement, notices, and electronic acceptance

The accepted Quote, this Agreement in the version identified above, and any approved written change orders constitute the parties’ agreement for the project. If a project-specific term in the accepted Quote conflicts with a general provision here, the expressly agreed project-specific term controls, except where applicable law requires otherwise.

The Customer and NJF may agree to conduct this transaction electronically. By electronically signing the Quote, the Customer intends to sign and accept the Quote and this incorporated Agreement. NJF will retain a copy of the signed Quote and the version of this Agreement provided to the Customer at acceptance.

Any notice, disclosure, cancellation form, or separate signature required by applicable law must also be provided or obtained in the legally required manner. A link to this Agreement does not replace such a requirement.

Service-specific terms

14. Garage organization, cabinets, storage, and custom closets

Applies only when the Quote includes these services.

The Quote controls the agreed layout, components, dimensions, finishes, accessories, and installation locations. Unless expressly included, NJF’s work does not include moving existing plumbing or electrical systems, structural modifications, repairing hidden wall damage, or relocating stored belongings.

The Customer will identify known plumbing, electrical, or other utilities concealed within walls or surfaces where components are to be installed. If NJF discovers a condition that prevents safe or suitable installation, NJF will discuss available options and any proposed change order before proceeding with affected work.

The one-year NJF workmanship warranty covers defects resulting from NJF’s installation. It does not cover damage caused by overloaded cabinets or shelves, misuse, impact, water intrusion, building movement, or failure of an existing wall or substrate that NJF was not contracted to repair. Product and hardware warranties, if offered by the manufacturer, remain separate.

15. Garage floor coatings

Applies only when the Quote includes floor coating services.

The Quote identifies the surfaces to be coated and the agreed coating system. NJF may perform ordinary surface preparation appropriate to that system, as described in the Quote. Structural slab repair, correction of underlying moisture problems, and other work not expressly quoted are excluded.

Existing cracks, control joints, slab movement, moisture or hydrostatic pressure, contamination within the concrete, and previously applied products can affect coating performance. NJF will notify the Customer if conditions discovered during preparation require a change to the agreed work.

The Customer must follow the curing, vehicle-use, cleaning, and maintenance instructions provided for the installed coating. NJF’s one-year workmanship warranty covers coating defects caused by NJF’s application workmanship. It does not cover new or recurring cracks caused by concrete movement; moisture or vapor pressure originating beneath the coating; damage from impacts, chemicals, abrasion, or improper use; or failure caused by a preexisting substrate condition outside NJF’s contracted scope.

Minor variation in flake distribution, texture, sheen, and color may occur as part of the installed coating’s appearance. A material departure from the agreed product or finish will be addressed under the applicable workmanship or product warranty.

16. Screen installation, rescreening, and screen repairs

Applies only when the Quote includes screen services.

The Quote identifies the screen panels, doors, hardware, framing components, or other items NJF will install, replace, or repair. Work on existing frames, fasteners, foundations, supports, doors, and enclosure components is excluded unless expressly listed.

Existing screen enclosures may have corrosion, weakened framing, damaged spline channels, loose fasteners, or other deterioration that becomes apparent when old screening or hardware is removed. NJF will notify the Customer if a discovered condition prevents suitable completion of the quoted work and will obtain approval before performing additional chargeable repairs.

For repairs or rescreening of an existing enclosure, NJF’s one-year workmanship warranty covers defects caused by NJF’s installation of the quoted materials. It does not warrant the remaining service life or structural condition of preexisting framing, spline channels, fasteners, foundations, or other components NJF was not contracted to replace or repair.

The workmanship warranty does not cover damage caused by storms, high winds, falling objects, pets, impacts, misuse, or subsequent alterations. Manufacturer warranties on screen material or hardware, if any, are separate.

Any structural enclosure construction or alteration is subject to applicable licensing, permitting, engineering, and inspection requirements. NJF will confirm those requirements for the specific project before undertaking regulated work.
